By purchasing my art services, you agree to the following conditions. Please read this entirely and carefully. I will deny your project if you do not agree to these terms. If you have any questions, please contact me.

 

Throughout this I will refer to the buyer as (Client) and myself as (I).

I retain my right to refuse ANY project from ANY client for absolutely ANY reason, OR for no reason at all. I have full rights to decline a project without offering explanation.

1. PAYMENT

ALL PAYMENTS ARE TO BE PRE-PAID BEFORE I START ANY WORK, AS A PAYPAL INVOICE, IN USD.

All payments unless otherwise stated shall be; Paid before work is begun, USD, delivered via a PayPal Invoice. Other currencies such as "points" or vouchers shall only be accepted by special appointment, and are not a typical currency for me. I reserve the right to refuse accepting projects that would be paid in a currency I do not currently accept. All projects are PRE-PAY only unless noted otherwise, and I will not begin work on any project until payment has been received. I DO NOT accept payments from shared PayPal accounts, minors using a parent's PayPal account, or accounts with no standing. (Brand new accounts/Empty accounts). 

 

Do not base your expected price for any project on past projects with other clients. Every client and project is different, and in many cases, discounts have been given, or gratuities have been added. Discuss payment size, time-frame and more with me individually for each project. All prices are negotiable. Please contact me to discuss, as each project and client is different.

 

2. REFUNDS AND CANCELLATIONS

YOU CANNOT GET A FULL REFUND IF I HAVE ALREADY BEGUN, OR FINISHED YOUR WORK.

Once I start your commission, I will not refund you the full amount. This is negotiable depending on individual details. Because of PayPal fees, taxes and transfer fees, I will only refund %80 MAXIMUM if by client's fault. If for my own reasons, I must cancel a project however, I will reimburse the lost fees and refund %100. Once a project is complete and delivered I will not refund any amount for any reason. Please be aware that you are paying for my time as an artist to work on your project, and time is not something I can get back. If you are unhappy with a project please be honest with me during the process so things can be adjusted.

3. CHARGEBACKS

YOU MUST CONTACT ME ABOUT REFUNDS. PAY REVERSALS OR CHARGEBACKS ARE FORBIDDEN.

If for some reason your PayPal account is not working, or authorizes a refund request without you knowing somehow, you must contact me as soon as possible in order to resolve the issue. Issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting for you, your email address, and anyone sharing your paypal account, including side accounts. Absolutely do not ever issue a chargeback to my paypal. Doing so can compromise all of my family's finances, my paypal, my bank account, the failure of automatic bill payments, ect. CHARGEBACKS ARE ABSOLUTELY FORBIDDEN. If you absolutely need to cancel a project you MUST contact me for a refund BEFORE COMPLETION of project. I repeat, DO NOT EVER ISSUE A CHARGEBACK THROUGH PAYPAL!

4. SHIPPING 

I DO NOT SHIP ANYTHING UNLESS STATED IN EACH SPECIFIC PROJECT CORRESPONDENCE. 
The majority of my services are Digital Artwork, Digital Delivery ONLY. I DO NOT PHYSICALLY SHIP ANYTHING TO CLIENTS UNLESS STATED OTHERWISE WITHIN OUR DIRECT PROJECT CORRESPONDENCE TO EACH SPECIFIC PROJECT. 
If a project is to be shipped, shipping cost will usually be included in the project's price. If additional shipping fees occur, it will be discussed with the client. All tangible project clients who desire the item to be shipped must be willing to provide their address and location prior to beginning the project, as shipping to certain countries is impossible. For clients outside the USA, customs fees may be incurred. 
 

5. ARTIST RIGHTS

I RETAIN MY RIGHTS TO USE ANYTHING I CREATE, HOWEVER I WILL RESPECT YOUR PRIVACY WISHES IF STATED BEFORE WORK BEGINS.

By commissioning me, you are purchasing my services as an artist only. I retain all copyrights over my work, which include but are not limited to the right to redistribute, reproduce, or use the image as a sample for sales/self-promotion, unless otherwise agreed upon.

• I will respect your request for privacy if you'd prefer me not to post your project publicly. Discuss with me prior to starting.
• I will not claim the Intellectual Property or reuse/resell your project/design for personal or commercial projects unless agreed upon.
• I reserve the right to decline any project or client for any reason without question. This includes clients who have not read these terms.
• I reserve the right to use rejected sketches for any future project, be it personal or otherwise.

6. CONTENT AND THEMES
I RESERVE THE RIGHT TO DECLINE PROJECTS FOR ANY REASON
I decline to do client projects related to, but not limited to the following; Religion, Politics, Illegal actions, Couple Art, Self-Harm, Furries or sexualized animals or beasts, NSFW (including unclothed character reference sheets)

I am not limited to this list, and I retain the right to refuse any project or client for any reason without argument. No one is entitled to my services.

I also reserve the right to use listed themes in my own personal work, work for friends/family, or by my own discretion. I have standards and limits for client work, as it is very different than work I would do for personal reasons or for specific individuals, and I will not take on projects that I may not understand fully, or be able to complete within my skillset and style.

I will repeat, No one can force me, by any means, for any reason, to draw or write anything. I am a free individual and will not be coerced into working with materials or themes that I am not comfortable with, or do not understand. (Such as, but not limited to, depicting cultural ceremonies, religious items, things involving sexual identities, ect. for personal reasons and fear of misrepresenting or completing incorrectly.)

Also, My mental health is private and I will not be explaining why certain themes are off-limits for me. You will respect my privacy. 

7. CLIENT

CREDIT ME FOR WORK THAT I'VE DONE, DO NOT PROFIT FROM MY WORK WITHOUT PERMISSION.

Client may display my work on external sites as long as it is visibly credited and linked back to me. You  may not however upload or host my work in any gallery that is intended for your own work only (i.e. deviantart, weasyl, furaffinity, ect.) Once a piece has been commissioned, You may use it for personal uses, including but not limited to signatures, icons, avatars, layouts, wallpapers, themes and personal page/site displays.

• Client may not claim the work to be their own or anyone elses but mine. 
• Client may not edit it beyond recognition without permission. (Minor edits are permitted)
• Client may not set my work up for redistribution, external projects, commercial or non-commercial. (i.e. t-shirts, mugs, public flyers, ect)

 (If you are interested in such things, you must get permission from me prior to starting the project, as additional fees may apply)

6. SCHEDULE

LET ME KNOW IF YOU'RE IN A HURRY!

If a project has a deadline or time-frame that I'm expected to complete within, I must be alerted of this before payment is sent, and additional cost for rush order may be applied. In general I reserve the right to take up to 4 weeks to begin work on any project. Based on personal scheduling and other commitments, speed should not be expected, although I work hard to have a good turnaround time. Generally, I begin and complete projects in the order that payments are received, rush orders may change the queue order however.  

 

7. ADOPTABLES

CREDIT ME PROPERLY AND DO NOT SELL GIFTS.

The client in regards to adopted designs retains the right to the character design itself, the intellectual property. Client may not upload my artwork of the design to a gallery intended for your own work only. (i.e. deviantart/weasyl/furaffinity/ect) Client may add the character/design/art to a site intended for character sharing, provided it is all properly credited back to me with a working link. (i.e. Toyhou.se/Charahub/Character Weebly/Wix)

Rehoming

Client may gift or trade design to another person at any time. Client may resell a design for the price you purchased it for. Client may add additional cost to design to recoup revenue spent on additional art. Client may trade or gift a design with the understanding that all monetary value for that design is now lost. (You may not resell a design you received in a trade/gift unless that is the intended action by the gifter.) I do not recognize co-ownership. I will not intervene in any ownership disputes.

Client may not ever harass others over a design, or start a dispute with me or others about a design or payment issues. If you have a question or concern, please contact me as soon as possible in private to avoid unneeded drama. Client should not trade/gift/sell designs to people who are on blacklists/have payment issues/use a shared paypal account.

8. PROJECT PRESERVATION DISCLAIMER

SAVE BACKUPS OF WORK YOU'VE PAID FOR.
It is entirely the Client's duty to retain and save any information, sketches, finished works, cropped art sets, and any other digital items I provide for them within the project.
• Any file you paid for will be available from me for a finite time only, and not guaranteed available after the initial delivery!
• I am not required or bound to post your project in any public space, and if posted, I am not required or bound to keep it there indefinitely.
• I reserve the right to delete or remove any public project, even if you paid for it, as you should have your own copy saved for personal use as defined in above sections.
• I take measures to preserve most files in safe locations if Client would ever need a new copy in the future, but I cannot guarantee against computer failure or accidental deletion or loss.

SAVE WHAT YOU PAID FOR

9. MY RIGHTS cont.
I retain the right to decline ANY project from ANY client for ANY reason at ANY time without having to defend myself, provide reasoning or enter a dispute with them. I provide my SERVICES as an artist upon my own whim and NO one has ANY right whatsoever to my time or work and I WILL NOT be compelled or coerced or "guilt-tripped" for any reason to draw something I do not want to draw, or to take part in ANY project I do not feel comfortable or well suited to complete.

10. NFT and AI 
I do not support, agree to, or allow any of my artwork, designs, productions or products to be used as NFTs in any way, shape or form. You may not upload/edit/copy/screenshot/use anything originated with/by myself as any type of digital coin/currency/NFT. If you find my work being minted or used in this way please contact me, as it is illegal use and I will promptly file the proper forms for deletion and removal.

Additionally, I do not support, agree to, or allow any of my artwork, designs, productions or products to be used within any Artificial Intelligence program or LearnSet, in any way, shape or form. You may not upload/edit/copy/screenshot/use anything originated with/by myself as any type of AI produced image. I do not support the use of AI in any part of the creative process, and I do not use any AI in any way during any of my artistic endeavors. 

 

11. AGREEMENT TO THESE TERMS
By commissioning me you agree to these terms and agree that you will not attack me if I am unable to work with your request. Please be honest about your intentions during correspondence to avoid any confusion. In the event of a dispute or disagreement about any project, this TOS will be provided as proof of my terms and Client's agreement to them as they stand.
